Homeschooling Under Attack: Lawmakers Push Bill That Could Send Parents To Jail

The recent proposal by Illinois Democrats, known as the "Homeschool Act," seeks to impose stringent regulations on homeschooling families. Under this act, parents would be mandated to report their homeschooling status to local public school officials starting in 2026. 

Failure to comply could result in Class C misdemeanor charges, punishable by up to 30 days in jail, along with fines and potential investigations by state child welfare officials. Additionally, parents would be required to provide a "portfolio" of their children's work at any time, subject to the satisfaction of public school authorities.

Proponents of the bill, such as suburban Chicago Democrat Terra Costa Howard, argue that these measures ensure educational standards are met, stating that compliant homeschool parents "are going to be able to do that." However, this perspective disregards the overwhelming evidence of homeschooling's superiority in academic performance, student well-being, and family autonomy. Furthermore, it ignores the increasing trend of families deliberately opting out of the traditional school system due to its deep-seated failures and ideological overreach.


The Rising Trend of Homeschooling

Homeschooling has experienced significant growth in recent years. In 2019, approximately 2.5 million students were homeschooled in the United States. This number rose to about 3.7 million by the 2020-2021 school year, representing approximately 6.8% of all school-age children. This surge is not merely a reaction to the COVID-19 pandemic but reflects a broader shift towards personalized education and a rejection of failing public institutions.

Academic Excellence Among Homeschooled Students

Empirical data consistently demonstrates that homeschooled students often outperform their public school counterparts. On standardized tests, homeschoolers typically score 15 to 25 percentile points higher than public school students. Moreover, over 78% of peer-reviewed studies indicate that homeschooled students perform statistically significantly better academically. These findings expose the flawed assumption that government intervention is required to ensure children receive a quality education.


Diverse Motivations for Homeschooling

Parents choose homeschooling for a variety of reasons, including dissatisfaction with traditional school environments, the desire for customized curricula, and concerns about safety and bullying. Many families are also motivated by the belief that parents know their children best and are therefore most capable of catering to their unique learning needs. Unlike a one-size-fits-all public school system, homeschooling allows for individualized instruction that nurtures strengths and improves weaknesses without unnecessary bureaucracy.

Another growing motivation for homeschooling is the increasing push of radical ideologies within public schools. Parents concerned about the infiltration of progressive social agendas, such as gender ideology, critical race theory, and explicit sexual education, see homeschooling as a means of protecting their children from inappropriate and unproven pedagogical trends. This ensures that children are raised according to family values rather than subjected to politicized narratives from activist teachers and school boards.

Furthermore, homeschooling eliminates unnecessary distractions found in public schools, such as excessive standardized testing, administrative inefficiencies, and social pressures that often lead to anxiety and depression in young students. The home learning environment fosters deeper family bonds, greater moral development, and a stronger sense of responsibility and self-discipline.


Global Recognition and Adoption

The homeschooling movement is not confined to the United States; it is gaining momentum worldwide. Countries like Australia have seen a significant rise in homeschooling, with numbers reaching record highs. This global trend underscores the growing recognition of homeschooling as a viable and effective educational alternative.

Concerns About Public School Systems

Critics of increased homeschooling regulation point to existing challenges within public school systems. In Illinois, more than two-thirds of eighth graders are not proficient in reading or math, according to the National Assessment of Educational Progress. Additionally, issues such as limited educational choices, past disciplinary practices, and instances of misconduct among staff have raised concerns among parents. Given this track record of failure, the idea that public school officials should oversee and regulate successful homeschool environments is absurd.

Homeschooling: A Right Worth Defending

The proposed "Homeschool Act" in Illinois appears to impose unnecessary burdens on homeschooling families, potentially deterring parents from choosing an educational path that has proven benefits. Given the documented academic successes of homeschooled students and the growing trend towards homeschooling both nationally and internationally, it is imperative to recognize and support the autonomy of parents in making educational decisions that best suit their children's needs. 

Rather than increasing government oversight of homeschoolers, lawmakers should focus on addressing the glaring deficiencies in the very institutions they seek to prop up.
